Terms and Conditions of Use

The directives governing the use of our platform aim to ensure you a pleasant and secure experience when planning your bus trips.

Article 1: Purpose
These terms of use are intended to define:

  • The contractual relationship between the Data Controller and any natural or legal person wishing to make a reservation for bus transportation via the Site, followed or not by the purchase of a ticket (hereinafter referred to as the "User").
  • The conditions applicable to any reservation and purchase made through the Site (hereinafter referred to as the "General Terms of Use").

The User acknowledges that validating a reservation for a transportation ticket through the Site implies unconditional acceptance of these General Terms of Use, full knowledge of them, and a waiver of their own purchase conditions, where applicable.

Before making a reservation, the User declares that they have full legal capacity to agree to these General Terms of Use and that the planned reservation and purchase are strictly for personal use.

To comply with new regulations or improve the use of the Site, the Data Controller reserves the right to modify the General Terms of Use accessible online at any time and at its sole discretion. These modifications will apply to the User and the Transporter on the date of the User's reservation validation, without any additional formalities required from the Data Controller.

Article 2: Transport Offers
The transport offers presented on the Site pertain to bus trips under the conditions described on the Site and within the availability limits. Transporters may update the offers at any time, ensuring that the applicable price is that in effect on the day the reservation is validated.

Article 3: Transport Prices
The transport prices displayed on the Site are in Moroccan Dirhams (MAD), inclusive of all taxes (VAT), based on the applicable rate on the reservation validation date. Any changes in VAT rates may affect the transport prices.

Article 4: Transport Reservation
To reserve a transport offer, the User must select an option matching their criteria on the Site. A summary of the reservation, including the ticket price, will be sent to the User. After verification, the User must confirm the reservation details, provided they have accepted these General Terms of Use.

All selected information and the validation of the reservation recorded by the Data Controller will serve as proof of the transaction. Once validated, the reservation cannot be modified by the User.

Before reserving a transport ticket, the User may create an account on the Site. The account creation section is accessible from the sidebar menu. During subsequent visits, the User must log in using their credentials to reserve or view their account. A User can request account closure at any time via the [markoub.ma/contact] Profile section. Confirmation of account closure will be communicated via email.

In case of difficulty during the reservation process, the User may contact the Data Controller by mail at [8 Place des Alaouites, Av Abou Faris El Marini, Rabat, Morocco] or by phone at [+212 (0) 5 3000 3000].

Article 5: Payment and Reservation Confirmation
A reservation is only finalized once the User has paid for the ticket, after which the Data Controller will send a confirmation email. Payment must occur before the transport sale closes; otherwise, the reservation cannot be confirmed.

The User can pay for their ticket using the following methods:

  1. Cash Payment via Partner Money Transfer Network: Users can visit authorized outlets with their pre-reservation reference to pay in cash. A receipt will be issued upon payment, and the reservation will be confirmed via email by the Data Controller.
  2. Secure Online Payment via [Interbank Payment Center]: After reservation validation, Users will be redirected to the secure [CMI] interface to enter banking details safely. If the payment is approved, the transaction is finalized and confirmed by email, serving as the transport ticket.

In case of fraudulent use of banking details to purchase a ticket, note that the Data Controller cannot provide traveler identity information to the bank via CMI, as this data is not processed when accessing the vehicle.

Once a reservation is confirmed, the User cannot request cancellation for any reason unless exercising their right of withdrawal.

Article 6: User's Right of Withdrawal
In accordance with Law No. 31-08 promulgated by Dahir No. 1-11-03 on February 18, 2011, regarding consumer protection, Users purchasing a transport ticket from the Site may exercise their right of withdrawal within 7 days of reservation validation without justification, indemnity, or penalty. However, this right cannot be exercised if the ticket has already been used or after the transport date.

To exercise this right, the Client must contact Markoub.ma’s customer service within 7 days to express the intent to withdraw. Refunds resulting from this withdrawal will be processed within 15 days.

Please note that tickets from CTM, Supratours, SAT, Ghazala Trans, and Supplementary Buses are non-modifiable, non-cancelable, and non-refundable, as per their respective policies.

Article 7: Transport Access
Only Users with tickets issued by authorized outlets or confirmed reservations can access the buses. In case of overbooking, the Transporter will offer an alternative seat under similar conditions at no additional cost.

All travelers purchasing tickets on the Markoub.ma platform must carry valid identification documents as required by Moroccan authorities. Failure to comply with these regulations is the passenger's responsibility, and they will not qualify for refunds or modifications.

Article 8: Data Controller's Liability
The Data Controller is only bound by a duty of care and is not responsible for issues arising from internet use, such as data loss, intrusion, or service interruptions, unless directly caused by the Data Controller.

Additionally, since the Site only serves as an intermediary between the Transporter and the User, the Data Controller is not liable for incidents during transport.

Article 9: Intellectual Property
All Site elements, including its presentation, design, texts, images, data, "Markoub.ma" brand, and logo, remain the exclusive property of the Data Controller. Any reproduction, modification, or exploitation of these elements is strictly prohibited.

Article 10: Users' Personal Data

10.1 - For the purpose of reserving and paying for transportation tickets, the User expressly and unreservedly agrees to transmit the following personal data via the Site: first name, last name, email address, mobile phone number, and banking details. The User commits to ensuring the accuracy of this data, which must verify their identity (hereinafter referred to as "Personal Data").

All Personal Data is protected under applicable regulations and will be processed exclusively for the operation of the Site. The User explicitly agrees that the Data Controller may share this Personal Data with the Transporter responsible for the booked trip, the online payment service, and the financial institutions managing the commercial transaction.

To ensure compliance with these data protection standards, the Data Controller has made the necessary prior declarations to the National Commission for the Protection of Personal Data (CNDP), recorded on [____] under number [________].

All Users' Personal Data is stored under optimal security and confidentiality conditions by the Data Controller's technical services.

The User's Personal Data will also be stored using Cookies. However, the User may explicitly refuse the use of cookies by selecting the option [Exit the site].

10.2 - In accordance with Dahir No. 1-09-15 of February 18, 2009, promulgating Law No. 09-08 concerning the protection of individuals with regard to the processing of personal data, and its implementing decree No. 2-09-165 of June 18, 2009, any User has the right to access, modify, rectify, or delete their Personal Data. To exercise this right, the User may directly access their personal account and/or send a request to the technical service via the Site at the section markoub.ma/contact

10.3 - The User may also authorize the Data Controller to send promotional offers from Transporters via email. This consent must be given explicitly and unequivocally by selecting the option [I have read and accept the general terms and conditions]. The User may opt-out of receiving such promotional offers at any time by sending a message to markoub.ma/contact.

10.4 - The User acknowledges and agrees that the Data Controller may retain their Personal Data for the duration necessary to complete the booked trip and its associated financial transaction, as well as for the duration the User's account remains open, if applicable.

Article 11: Security and Service Continuity Guarantees

The Data Controller has implemented all appropriate technical and organizational measures to ensure secure use of the Site, including preventing the accidental distortion, damage, destruction, or loss of Personal Data, as well as unauthorized access or illegal dissemination by third parties, and any other form of unlawful processing.

The Data Controller is committed to ensuring the Site remains accessible. However, the User acknowledges that interruptions may occur due to accidents, internet network saturation, or maintenance and updates of the Site. It is specified that no interruptions, regardless of their nature, will entitle the User to compensation.

Article 12: Dispute Resolution

These General Terms of Use are governed by Moroccan law. In the event of a dispute and failing an amicable resolution, the Commercial Court of Rabat shall have exclusive jurisdiction.
